Terms and Conditions for Tongue Fu Talking™ Subscription Website

These Terms and Conditions govern the use of the website tonguefutalking.chrisquigley.co.uk, a subscription platform operated by Chris Quigley Education Ltd, Highfield House, 38 Cade Hill Road, Stocksfield, Northumberland, NE43 7PU, United Kingdom. Contact: enquiries@chrisquigley.co.uk

By purchasing a subscription and accessing this website, you (the subscribing organisation) agree to be bound by the terms set out below. If you do not agree, you must not access the Site or use any resources.

 
1. Definitions
“Site” means tonguefutalking.chrisquigley.co.uk.
“Subscriber” means the organisation, school, or trust that has entered into a paid subscription agreement with us.
“Resources” means all content provided through the Site, including (but not limited to) documents, templates, videos, illustrations, and training materials.
“We”, “us” and “our” refers to Chris Quigley Education Ltd.
“You” and “your” refers to the subscribing entity (i.e. the school, trust or organisation).
 
2. Business-to-Business Terms
Chris Quigley Education Ltd supplies its services solely on a business-to-business (B2B) basis. Schools, trusts, and other educational organisations are treated as business clients, not consumers. Accordingly, consumer rights legislation (including the Consumer Contracts Regulations 2013) does not apply to your subscription.

 
3. Subscription Access and Use
Access is provided solely to the purchasing organisation for the term of the subscription.
Subscriptions are billed annually and must be paid in advance.
Subscription fees are non-refundable, including in cases of unused access, changes in school personnel, or internal restructuring.
Access may not be transferred to other schools or third parties without prior written consent.
 
4. Intellectual Property and Usage Rights
All materials available on the Site are the intellectual property of Chris Quigley Education Ltd and are protected by copyright laws and international treaties. As a Subscriber, you are granted a limited, non-exclusive, non-transferable licence to use the resources within your organisation under the following terms:

You may:

Download and use the resources within your own school or trust for educational purposes.
Share them internally with staff and pupils via secure internal systems (e.g. password-protected intranets).

You may not:

Share, distribute, publish, or upload resources externally, including to social media, public websites, blogs, or online platforms.
Adapt, modify, rebrand, or translate resources without written permission.
Sub-license, resell, or represent the resources as your own work.
Any such action is a breach of contract and intellectual property rights and may result in termination of access without refund and legal proceedings where appropriate.

 
5. Attribution and Referencing
If you reference Tongue Fu Talking™ content in your school improvement plans, curriculum frameworks, training materials, or external publications, you must include appropriate attribution:

6. Monitoring and Enforcement
We reserve the right to:

Monitor downloads and user activity for compliance.
Use watermarking or digital tracking to identify unauthorised distribution.
Immediately suspend or revoke access for breach of these terms.
Pursue legal remedies for infringement or unauthorised use.
 
7. Modifications to Terms
We may revise these Terms from time to time. Updates will be posted on the Site, and material changes may also be notified by email. Continued use of the Site following any changes constitutes acceptance of the revised terms.

 
8. Privacy and Data Protection
We are committed to handling your data responsibly and in compliance with the UK General Data Protection Regulation (UK GDPR). See our Privacy Policy for full details.

 
9. Limitation of Liability
We take care to ensure the accuracy and usefulness of our materials but make no guarantees of outcomes resulting from their use. We accept no liability for:

Indirect, special, or consequential loss or damage.
Loss of revenue, profits, or data.
Any interruptions or errors on the Site.
Our total liability under this agreement shall not exceed the value of your annual subscription fee.

 
10. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.

11. Other  Chris Quigley Education reserves the right to terminate your Tongue Fu Subscription if payment is not received or if terms are violated. You have access to the Tongue Fu site for 1 year. This is a one off payment and no refunds/reimbursements will be made during the period. Resubscription is due at the end of the period. This is an agreement between the school and Chris Quigley Education, not with the signing individual. Once your subscription is active your invoice is due in line with our Terms and Conditions.
